Terms of Purchase
1. General Provisions
1.1. These rules for purchasing and selling goods (hereinafter referred to as the Rules) are a legally binding document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and Seller when the Buyer purchases goods in the online store.
1.2. The Seller reserves the right to change, amend, or supplement the Rules at any time in accordance with legal requirements. The Buyer will be informed via the online store’s website. The Rules in effect at the time of order placement apply when the Buyer shops in the online store.
1.3. The following individuals have the right to purchase in the online store:
1.3.1. Legally capable natural persons, i.e., adults whose legal capacity is not restricted by court order;
1.3.2. Minors aged 14 to 18 years, only with parental or guardian consent, except in cases where they independently manage their income;
1.3.3. Legal entities;
1.3.4. Authorized representatives of all the above-mentioned individuals.
1.4. By confirming the Rules, the Seller guarantees that the Buyer, in accordance with section 1.3 of the Rules, has the right to purchase goods in the online store.
1.5. A contract between the Buyer and Seller is considered concluded from the moment the Buyer, having formed a shopping cart, provided the delivery address, selected a payment method, and reviewed the Seller’s Rules, clicks the “Confirm Order” button (see section 5 “Order Placement, Prices, Payment Procedures, Deadlines”).
1.6. Each contract concluded between the Buyer and the Seller is stored in the online store.
2. Protection of Personal Data
2.1. The Buyer can order goods in the online store:
2.1.1. By registering in the online store and entering the required registration data;
2.1.2. Without registering in the online store.
2.2. When ordering goods using the methods specified in section 2.1 of the Rules, the Buyer must provide the personal data necessary for the proper execution of the order: name, surname, delivery address, phone number, and email address.
2.3. By confirming these Rules, the Buyer agrees that the personal data provided under section 2.2 will be processed for the purposes of selling goods and services in the online store, analyzing the Seller’s operations, and direct marketing.
2.4. By agreeing to the processing of their personal data for the purpose of selling goods and services in the online store, the Buyer also consents to receiving informational messages necessary for order fulfillment at their specified email address and phone number.
2.5. By registering in the online store and ordering goods, the Buyer agrees to protect their login information and not disclose it to anyone.
3. Buyer’s Rights and Obligations
3.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules and other guidelines in the online store’s information sections.
3.2. The Buyer has the right to withdraw from the purchase-sale contract with the online store by notifying the Seller in writing (via email, specifying the product to be returned and its order number) no later than 14 (fourteen) working days from the delivery date, except in cases where withdrawal is not permitted under Lithuanian law (e.g., for hygiene products such as bedding; see section 18 of the “Specifics of Returning and Exchanging Non-Food Products” on the Consumer Center’s website).
3.3. The Buyer can exercise the right specified in section 3.2 only if the product has not been damaged or substantially altered in appearance and has not been used.
3.4. The Buyer agrees to accept the ordered goods and pay the agreed price for them.
3.5. If the Buyer’s registration data changes, they must update it immediately.
3.6. The Buyer agrees not to disclose their login details to third parties. If the Buyer loses their login information, they must inform the Seller immediately via the contact details provided in the “Contacts” section.
3.7. By using the online store, the Buyer agrees to these purchase-sale Rules and undertakes to comply with them and the applicable laws of the Republic of Lithuania.
4. Seller’s Rights and Obligations
4.1. The Seller undertakes to ensure that the Buyer can properly use the services provided by the online store.
4.2. If the Buyer attempts to harm the stability and security of the online store or violates their obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer’s access to the online store or, in exceptional cases, cancel the Buyer’s registration.
4.3. The Seller undertakes to respect the Buyer’s right to privacy regarding their personal information provided in the registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering Goods, Prices, Payment Procedures, and Deadlines
5.1. The Buyer can shop in the online store 24/7.
5.2. The contract becomes effective when the Buyer clicks the “Confirm Order” button, and the Seller confirms the order by sending a confirmation email to the Buyer.
5.3. Prices in the online store and in the order are indicated in euros, including VAT.
5.4. The Buyer can pay for the goods using one of the following methods:
5.4.1. Online Banking: Payment via the Buyer’s online banking system, requiring a prior agreement with one of the listed banks (e.g., SEB, Swedbank). The payment is transferred to the online store’s account. Data security responsibility lies with the respective bank.
5.4.2. Bank Transfer: The Buyer transfers the money to the online store’s account after printing the order and visiting the nearest bank branch.
5.5. The Buyer agrees to pay for the goods immediately. The goods will only be prepared for shipment after payment is received, and the delivery time will begin.
6. Delivery of Goods
6.1. The Buyer agrees to provide an accurate delivery address when ordering.
6.2. The Buyer must personally accept the goods. If the Buyer is unavailable and the goods are delivered to the specified address, the Buyer cannot claim incorrect delivery.
6.3. The goods are delivered by the Seller or an authorized representative (courier).
6.4. The Seller delivers goods in accordance with the terms specified in the product descriptions. These terms are approximate and do not apply when the required goods are unavailable, in which case the Buyer is informed. In exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control.
6.5. The Seller is not responsible for delivery delays if caused by the Buyer’s fault or circumstances beyond the Seller’s control.
7. Product Quality and Warranty
7.1. The details of each product are provided in the product description.
7.2. The Seller is not responsible for discrepancies in product color, shape, or other parameters due to the Buyer’s display settings.
7.3. Certain products may include a warranty, the terms of which are specified in their descriptions.
7.4. If no warranty is provided, legal warranty terms apply.
8. Returns and Exchanges
8.1. Faulty goods are repaired, exchanged, or returned in accordance with Lithuanian laws.
8.2. To return goods, the Buyer must notify the Seller within 14 days, providing the product name, order number, and return reason.
8.3. Returned goods must comply with specific conditions (e.g., original packaging, no damage, unused).
8.4. The Seller has the right to refuse goods that do not meet return conditions.
8.5. In case of incorrect or faulty goods, the Seller must replace or refund the product.
9. Liability
9.1. The Buyer is responsible for the accuracy of their data.
9.2. The Seller is not liable for issues arising from Buyer errors or third-party access to their account.
10. Marketing and Information
10.1. The Seller may run promotions at its discretion.
10.2. Promotions can be altered or canceled without notice, effective only for future transactions.
11. Final Provisions
11.1. These Rules are governed by Lithuanian laws.
11.2. Disputes are resolved through negotiation or legal action if necessary.
